Terms of Service
Effective date: May 2, 2026
These Terms of Service (“Terms”) govern your use of the IntelliCall service provided by IntelliCall LLC (“IntelliCall,” “we,” “us”). By using our service, you agree to these Terms.
1. The service
IntelliCall provides AI-powered voice answering, order taking, and payment infrastructure for restaurants. Specific features and limits are described on our pricing page and in your service agreement.
2. Eligibility
You must be at least 18 years old and authorized to enter into agreements on behalf of your business to use IntelliCall.
3. Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Acceptable use
You agree not to use IntelliCall to:
- Violate any law or regulation
- Send unsolicited or harassing communications
- Infringe on the rights of others
- Interfere with the operation of the service
5. Fees and payment
Service fees are billed monthly as described on our pricing page. Stripe processing fees are passed through at cost. Failure to pay may result in service suspension.
6. Cancellation
You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.
7. Service availability
We work hard to keep IntelliCall running, but we do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Twilio, Stripe, your POS provider), and force majeure events may affect availability.
8. Intellectual property
IntelliCall and all related software, logos, and content are the property of IntelliCall LLC. You may not copy, reverse engineer, or resell the service without written permission.
9. Disclaimer of warranties
The service is provided “as is” without warranty of any kind. We do not guarantee that the AI voice agent will capture every order accurately or that all calls will result in completed transactions.
10. Limitation of liability
To the maximum extent permitted by law, IntelliCall’s total liability for any claim arising from the service is limited to the amount you paid us in the three months before the claim arose.
11. Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Milwaukee County, Wisconsin.
12. SMS and transactional messaging program
This section describes IntelliCall’s text messaging program under these Terms.
Program description
IntelliCall sends transactional text messages on behalf of participating restaurants. Messages include payment links, order confirmations, and order status updates for orders placed by phone using the IntelliCall AI voice agent.
How you opt in
When you place an order by phone using a restaurant’s IntelliCall voice line, the AI agent will ask whether you want to receive a payment link or confirmation by text message.
By saying yes and providing your phone number, you consent to receive transactional SMS messages from IntelliCall related to that order.
Consent is logged with a timestamp and is required only for that specific order. We do not store your number for ongoing marketing.
Message frequency
You will receive 1 to 3 messages per order (typically: payment link, payment confirmation, and order ready notification).
Cost
Message and data rates may apply. IntelliCall does not charge you for the messages, but your mobile carrier may. Check with your carrier for details.
Supported carriers
Carriers are not liable for delayed or undelivered messages. Compatible with all major U.S. carriers including AT&T, Verizon, T-Mobile, and most regional carriers.
How to get help
Reply HELP to any IntelliCall message to receive assistance, or email support@intellicall.tech or hello@intellicall.tech.
How to opt out
Reply STOP to any IntelliCall message to opt out of all future messages. You will receive one confirmation message and will not receive further texts unless you opt in again on a future order.
Privacy
We do not sell or share your phone number with third parties for marketing. See our Privacy Policy for details on how we handle your information.
13. Changes
We may update these Terms. Continued use after changes means you accept the new Terms.
